Which court will hear your case?
The Ontario Court of Justice and Superior Court of Justice have different roles in criminal proceedings. The court that deals with a particular step depends on the charge, the applicable procedure and the stage of the case. A case may involve appearances in more than one court.
We explain the process, identify the next required appearance and prepare for the issues the court can decide at that stage. For Superior Court scheduling and local contact information, consult the Superior Court of Justice — Belleville court information page. The Court also maintains an all-court-locations directory.
Criminal, youth and federal charges
Criminal charges can affect liberty, employment, family responsibilities, professional standing and immigration status. We examine the allegations and disclosure, assess the admissibility and reliability of the evidence, and consider available defences and resolution options. Advice is tailored to the individual rather than based only on the name of the offence.
Youth matters require attention to the distinct legal framework for young persons, age-appropriate advice, privacy protections and the role of a parent or other supportive adult where appropriate. We help young persons and their families understand the proceeding and prepare for the next step.
Drug allegations and other federally prosecuted offences may involve searches, seizures, digital records, expert evidence and substantial disclosure. We assess the prosecution’s case, potential Charter issues and the consequences of a proposed plea or finding of guilt. Where bail or release conditions are involved, we work on a practical plan and explain the importance of complying with the court’s orders.
Attending court in person or virtually
Check the court, courthouse, date, time and method of attendance shown on your notice or release documents. Living in a particular municipality does not by itself determine where every case will be heard. Matters involving residents of Belleville or surrounding communities may be scheduled at different locations, depending on the court and type of proceeding.
The Ontario Court of Justice publishes virtual court attendance and scheduling information. Search for Belleville and confirm the information for your particular court and type of appearance. A published video link does not mean every hearing can be attended remotely. Follow any direction from the court and confirm arrangements with counsel or the court office if you are unsure.
Superior Court attendance and scheduling arrangements should be checked through the Belleville Superior Court page and the directions applicable to your proceeding. Do not assume that an Ontario Court of Justice connection link applies to a Superior Court matter.
Extradition proceedings
In Ontario, judicial extradition proceedings are heard in the Superior Court of Justice, not the Ontario Court of Justice. The Minister of Justice has a separate role in deciding surrender. Extradition is not a trial of the foreign allegation and requires a strategy addressing the judicial and ministerial stages, as well as interim release where applicable.
Our Extradition practice page explains committal, defence evidence, bail, ministerial submissions, appeals and judicial review.
